General Statement

The City of Kyle's Board of Adjustment is comprised of volunteer members asked to perform certain duties as needed and required by the City Charter. As a member of the City of Kyle Board of Adjustments, you'll be asked to adhere to the same core values as city employees. These Core Values are as follows:

Membership:

The Board of Adjustment is responsible for hearing and determining appeals regarding the refusal of building permits, appeals resulting from administrative decisions and can permit an exception to, or variation from, the zoning regulations. The Board consists of five members serving two-year terms. The members of the Board of Adjustment are appointed by the Council and serve without compensation. In making appointments to the board, the Council shall seek to ensure broad representation and expertise among the membership.

Meeting Date: 1st Wednesday of each month, 6:30 PM (as needed to meet)

Location: City Council Chambers, 100 W. Center St.


Purpose:

  • Address appeals based on error
  • Hear and decide Special Exceptions
  • Authorize Variances
  • Conduct hearings regarding Unsafe Buildings
  • Act as the Sign Control Board

The Board of Adjustment is charged with the duty and invested with the authority to act as follows:

  • Appeals based on error.The board of adjustment shall have the power to hear and decide appeals where it is alleged there is an error in any order, requirement, decision, or determination made by an administrative official

2) Special exceptions. The board of adjustment shall have the power to hear and decide special as follows:

  1. To permit a public utility or public service use or structure in any district as necessary to house equipment, pumps, switching gear, and similar devices only, required for the provision of the utility service or a public utility or public service building of a ground area and of a height at variance with those provided for in the district in which such public utility or public service building is permitted to be located, when found reasonably necessary for the provision of utility service and the public health, convenience, safety or general welfare.
  2. c. Authorize a variance from the parking and loading requirements in any of the districts whenever the character or use of the building is such as to make unnecessary the full provision of parking or loading facilities, and where the topography or unusual shape of the lot and regulations would impose an unreasonable hardship upon the use of the lot, as contrasted with merely granting an advantage or a convenience.

3) Variances. The board of adjustment shall have the power to authorize upon appeal in specific cases that will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of this chapter will result in unnecessary hardship, and so that the spirit of this chapter shall be observed and substantial justice done, including the following:

  1. Yard and setback.Permit a variance in the yard requirements of any district where there are unusual and practical difficulties or unnecessary hardship in the carrying out of these provisions due to an irregular shape of the lot, topography or other conditions; provided that such variance will not significantly affect any adjoining property or the general welfare.
  2. Structures.Authorize upon appeal, whenever a property owner can show that a strict application of the terms of this chapter relating to the construction or alteration of a building or structure or the use of land will impose unusual and practical difficulties or particular hardship, such variances from the strict application of the terms of this chapter as are in harmony with its general purpose and intent, but only when the board of adjustment is satisfied that a granting of such variance will not merely serve as a convenience to the applicant, but will alleviate some demonstrable and unusual hardship or difficulty so great as to warrant a variance as established by this chapter, and at the same time, the surrounding property will be property protected; provided that the board of adjustment shall not in any event permit a use on any property that is not permitted within the zoning category for which such property is zoned.

(4) The board of adjustment shall schedule and hold a hearing and hear testimony from the building official, the owner and other persons having an interest in an unsafe or dangerous building, and any person desiring to present factual evidence relevant to the unsafe building. Additionally, the board shall decide, by majority vote, whether said building is unsafe or dangerous.

(5) Sign Control Board, powers.

  1. To hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the building official in the enforcement of this chapter.
  2. b. To hear and decide special exceptions to the terms of this ordinance upon which the SCB is required to pass.
  3. c. To authorize, upon appeal in specific cases, such exception from the terms of this chapter as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of this ordinance will result in unnecessary hardship, and so that the spirit of this chapter shall be observed and substantial justice done.
